I have questions about Juan Hernandez, American citizen now holding a cabinet position in Mexico and doing all he can to protect Mexican nationals unlawfully present in the United States.

Is the United States in a state of war or not?

United States Constitution

Article I, Sec. 9, clause 8: "No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State." (Of course, Hernandez did not hold any "Office of Profit or Trust". So he gets by that one, I guess.)

Article III, Sec. 3, clause 1: "Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court."

(Can we consider giving "Aid and Comfort" to illegal aliens - certainly invaders can be considered enemies to the U.S. and potential terrorists, as many terrorists were unlawfully present - an act of treason?)
