DotSee highlights of VCT/American Patrol's Visit

DotBACKGROUND:

A "anti-bias rally" for the 2 Farmingville day laborers who were beaten in Shirley, Long Island, was held 15 Oct at the Suffolk County Governmental Center in Hauppague LI, NY. The rally was organized by Rabbi Steven Moss of the B'Nai Israel Reform Temple located in Oakdale Long Island NY. The Rabbi is a member of the Suffolk County Anti-Bias Task Force.

10/15/2000 - Mexicans boarding bus and arrogantly displaying a large Mexican flag in Farmingville, N.Y. The Mexicans were headed to Hauppauge to complain about Americans who want U.S. immigration laws enforced. An American was arrested at the protest for trespassing.... but the Mexicans were not. They were also trespassing, according to witnesses.

Church groups and Hispanic advocacy groups were invited to attend, along with members of Catholic Charities and hundreds of illegal aliens.

Congressman Felix Grucci attended the rally in his capacity as Brookhaven Town Supervisor. So did many local politicians such as Suffolk County Executive Gaffney and County Legislature President Paul Tonna.

Busses were dispatched by the organizers to many Long Island neighborhoods blighted by illegal alien day-laborer - to transport illegals to the Suffolk Counter Government Center in Hauppague.

At 4 Pm that Sunday, two of the busses which were sent to Farmingville pulled into the Staller property there and parked to pick up the Illegal aliens harbored in Farmingville to bring them to the County Center.

The busses parked in a place known as the Old Bald Hill Market - a marginally functional shopping center.

This property had been used before, illegally, by Hispanic advocates and church groups to gather to "vigil" with hundreds of aliens. Store owners petitioned the property owner (Staller) to prevent future such similar unauthorized activities as it negatively impacted their business and frightened customers.

As a result, Staller notified the police and made a request that all persons on the property who were not there to do business were asked to leave or be arrested.

The Staller arrest order had been in effect months before the rally.

Members of our community were very disturbed that illegal aliens harbored in our community would be bussed to this rally by its organizers ...... with the attendance and approval of local politicians and church groups and community leaders and as a result a demonstration was planned for that day in protest.

DotMARGARET'S ARREST:

As the SQL members (about 60 people) stood there with placards decrying illegal immigration, illegal aliens were loading with their enablers standing by. The police then hastily put a yellow tape about 100 feet away from the busses. As this was happening, two panel vans with Mexican and El Salvadorian flags flying continued to criss crossed the Staller property parking lot at a fairly high rate of speed (about 25 MPH) for many minutes in full view of the police.

The police did nothing about this although it created a dangerous condition. It almost appeared as if the police were there to escort the bus loads of illegals as they were not arresting them nor were they asking them to leave the property.

At this time Margaret tried to talk with police pointing out the fact that there was an arrest order for people such as the illegal aliens and their advocates for trespassing the parking lot and asking why the police were allowing and protecting a massive violation of the law while corralling and hassling the members of SQL.

For no apparent reason, the lieutenant in charge started to butt Margaret with his belly and rubbed it against Margaret in a provocative manner and threatened to arrest her .... without addressing her complaint.

About 20 minutes elapsed during which time various members of the group talked with the police asking why they were tolerating the illegals violations of the law. The police then ordered the SQL members off the Staller property as the illegal aliens continued to load on to the busses.

Staller's agent arrived and gave clear instructions to the police to ask everyone to leave or be arrested. He pointed to the busses, Bart Jones and the SQL members and reiterated: "everyone". SQL members including Margaret began to leave.

The SQL members did leave the property - including Margaret. This left the busses full of illegal aliens, the enablers the police and the reporter from Newsday - Bart Jones still on the property.

Margaret turned and asked the police why the illegals and their advocates were still allowed to remain in the Staller parking lot.

She was then grabbed by the police and arrested for:

1) Charge one: Criminal trespass

And then was taken in cuffs and tears to the 6th Precinct stationhouse.

DotAT THE STATIONHOUSE:

Margaret arrived at the stationhouse a. Soon after she was joined by SQL members and other concerned citizens of the community who were outside the stationhouse protesting the police.

During that 5 hours cuffed to a desk in the stationhouse, Margaret was subjected to additional humiliation and psychological pressure which she is not at liberty to discuss at this time. After 4 hours an additional charge was added to her arrest:

2) Resisting arrest

People present who had seen the arrest readily contradict this charge and they say Margaret did nothing of the sort. The only thing that could possibly have slowed the process is that Margaret has physical disabilities that make putting her arms behind her back almost impossible.

She left the stationhouse 5 hours later although normally a simple booking and a bail-out takes less than 20 minutes there.

Bart Jones, a reporter from Newsday, is listed on the charges as a witness against Margaret. Bart Jones is responsible for an attempt to have Margaret fired from her teaching job. Bart Jones was also responsible for trying to have the Glenn Spencer rally in Centereach stopped.

DotAFTERMATH:

Soon after, Peter Vallone the President of the NY City council questioned Margaret's ability to teach school children as he was informing the press that bias was the reason people were demonstrating. In addition a Hispanic NY City Councilman excoriated Margaret in the press and demanded her resignation.

The case has attracted national attention. In late October, a rally was held for Margaret in Farmingville which was organized by Glenn Spencer and Ezola Foster, US Vice Presidential Candidate who had suffered a similar humiliation in conjunction with questioning illegal immigration in the school district where she taught. Her salient comment on the situation ...... "Its a sad day for America when law makers conspire with law breakers against the law abiding citizens of the USA".

DotFACING THE CHARGES:

Margaret has since been arraigned 23 Dec pleading not guilty to two charges: Criminal Trespass carries a fine; Resisting arrest carries a maximum one year in jail and could end in the loss of her license to teach, leaving her without an income.

Since that time, there are several plea bargaining deals in progress for lesser charges but all would involve her pleading guilty to something she didn't do in order to prevent a trial which she cannot afford.

DotHERE'S NEWSDAY'S ACCOUNT OF MARGARET'S ARREST:

A multihued crowd of 2,000 people, carting homemade signs protesting a wave of anti-immigrant fervor in Farmingville, held a candlelight vigil last night in response to escalating racial tensions in the wake of a brutal attack on two Mexican day laborers. Even before the 6 p.m. rally kicked off, Suffolk County police arrested the outspoken leader of a group critical of the mainly undocumented day laborers who gather on Horse Block Road in Farmingville.

But the trespassing charges against Margaret Bianculli-Dyber, head of the Sachem Quality of Life Organization, did not disrupt the rally, where speakers included everyone from politicians, civil-rights activists and priests to immigrants from Kosovo and Latin America and a survivor of the Holocaust.

Breaking into bilingual chants of Gananemos la lucha! -- Spanish for "We will win the struggle! -- and "The people united will never be defeated, the crowd cheered as a dozen speakers vowed that Long Islanders will not tolerate bigotry.

DotNOTE:

Newsday never mentioned the thousands of illegal aliens who were bussed to the Suffolk County Government Center to attend the rally nor any of the circumstances leading up to Margaret's arrest.

Subsequent media accounts libeled SQL as a white supremacist racist organization and stated that Margaret assaulted the illegal aliens prior to arrest.
