AMERICAN PATROL FILED A LAWSUIT AGAINST THE LOS ANGELES TIMES AND DAILY NEWS
FIVE MONTHS LATER
THE COURT HAS YET TO RULE ON OUTRAGEOUS MOTIONS BY THE TIMES AND DAILY NEWS TO DISMISS THE SUIT.
IN THE MEANTIME, WE CAN DO NOTHING.

What the Times did
Our ad exposing Antonio Villaraigosa was to appear in the Los Angeles Daily News on Sunday, May 6, 2001 . The headline was "Do We Need A Mayor Who Reports to Mexico City?" It had been paid for and the final artwork delivered to the Daily News on May 1.
On May 3, the Times found out about the ad and demanded that we kill it, claiming that it violate their copyright. The next day they contacted the Daily News and demanded that the ad be pulled. The ad did use part of a front page of an old Times paper, but it did not violate the Times' copyright, and the Times the Daily News knew it. THEY KILLED IT ANYWAY!
The moment we learned of the Times' threat we contacted attorney Brian Buckley. He was with us throughout the entire ordeal. By late Friday, May 4, it was clear to us that the Times and Daily News had conspired to deny us our legal right to run a political ad. Over the next week we tried to convince them to reverse their positions. They would not. By Thursday, May 10, it was clear that our only recourse was the courts.SHOULD WE TAKE THE ISSUE TO COURT?
The question was: Should we sit idly by as these two newspapers deliberatly violated the law? Should we allow them to silence political dissent? I decided that we should not be silent. I decide to take this issue to the courts.
On May 11, 2001, VCT/American Patrol filed the lawsuit.The Los Angeles Times is Desperate
In its answer to our suit, the Daily News admitted that it killed the ad only because the Times threatened them. The Times admits threatening the Daily News but still claims copyright infringemet.
The Times is so desperate that they disqualified Superior Court Judge Buckner, the first judge assigned to the case, claiming that he was biased against them. (We understand that he says the pledge of allegience to open his court, which may explain why the Times feared him. They have a right to do this-once-and they exercized it.)
SLAPP
The Los Angeles Times is so desperate that they claimed in a motion to the court that we tried to stop them from exercising their freedom of speech, filing an anti-SLAPP motion to kill our lawsuit. They warned us that if their motion was granted, we would have to pay their legal fees.SLAPP means Strategic Litigation Against Public Participation. SLAPP suits are often used against little people to stop them from giving the big guys a hard time in public hearings. There is no public hearing involved in this issue, and the Times is the big guy and we are the little guy. The Times' claim that we are trying to deprive them of their freedom of speech is outrageous.
Media and the Law
The Daily News argues they had the right to refuse the ad. A book called Media and the Law, is considered to be the authority on the issue of newspaper ads. It was written by an expert. It says clearly that when the Daily News accepted our ad and cashed our check, they waived all their right to refuse to run it. The book was written by Rex Heinke, the Los Angeles Times' attorney.Court Fails to Act
The motions by the Times and Daily News were to be heard on August 28 by Superior Court Judge Emilie Elias . Our attorney, Brian L. Buckley, was totally confident of the outcome. JUST SEE WHAT HE PREPARED. The hearing was postponed.
We finally got in court on September 14th. Much to our surprise, instead of criticizing the Times and Daily News for frivolous motions, Elias acted as if she was counsel for the defense. She asked why we were suing the Times and Daily News since our "candidate" Hahn had won. Buckley was shocked. "That is the sort of question a high school kid would ask - not a judge."Elias in Times Camp
Just as the Times worried that Superior Court Judge Buckner would be biased against them, it is clear that Elias is biased against American Patrol. She can only do so much to help the Times and Daily News, however. Eventually (no later than the end of next month) she is going to have to rule on the outrageous motions to dismiss this case. If she rules against us, we will appeal and have her removed from the case. If she denies the motions we will prepare to go to trial.Why America is in Trouble
America is in trouble because of the liberal media bias. They have a globalist agenda dedicated to ending the sovereignty of the United States. Not only are they biased, they aggressively attack anyone who disagrees with them.
As we attempted to warn our fellow citizens of the failure of our government to enforce our immigration laws, a major Long Island newspaper smeared us as a "hate group." Did this newspaper contribute to the deaths of thousands of New Yorkers? We believe it did.
We Must Finish the Job
The Los Angeles Times has attempted to discredit us on a number of occasions. For the most part, their attacks are subtle. This time, however, they made a big mistake. They had to act quickly and that forced them to make a major error.
When we filed the lawsuit on May 11, we knew that the Times had threatened the Daily News. What we didn't know was that the Daily News would admit it right off the bat!
We have come a long way toward proving that our original complaint was absolutely correct.What We May Discover
We have taken the best the Times and Daily News can throw at us and we are still in the ring.
Thanks to your help, we are now positioned to unmask a major newspaper in a court of law. It is time for us to land some punches!
As we go to trial we can demand to know who in the Times made the decision to threaten us and the Daily News. Because of the circumstances that surrounded the killing of the ad, it is quite possible that some powerful person outside the Times initiated this action. If this is true, and we find out who, it would be a major scandal. (Which may be why the Times is using every trick in the book and all of their influence to keep us out of court.)The Next Step
Our next step is to press for a ruling from Judge Elias. She must rule before the end of November. Without question the law is entirely on our side . Elias may be having a difficult time making the decision because she wants to rule in favor of the Times and just can't figure out a way to do it. She knows we will appeal such a decision and that she will be reversed. Judges don't like being reversed but she may decide to fall on her sword for the L.A. Times!ON TO VICTORY!
With your help we can proceed to trial and win the final victory. Victory will mean exposing the liberal media in a way never before achieved. It could turn the tide of history and force the Times to tell the truth!
Battling the two largest newspapers in Los Angeles has been expensive. Our lawyers are not working on contingency. They have been paid in full for all the work they have done.
