Article 3 of the Constitution of the State of California says: "An administrative agency, including an administrative agency created by the Constitution or an initiative statute, has no power: (a) To declare a statute unenforceable, or refuse to enforce a statute, on the basis of it being unconstitutional unless an appellate court has made a determination that such statute is unconstitutional;" In 1999, Governor Gray Davis made a deal with the president of Mexico to remove Proposition 187 from consideration by the appellate court, thereby making it the law of the state. California is one successful lawsuit away from the courts ordering the enforcement of the provisions of Proposition 187. A governor Bill Simon can end this state of confusion by resubmitting Proposition 187 for consideration by the federal appeals court. The people deserve their day in court and California deserves a governor who obeys the law.
