On December 5 the U.S. Supreme Court will decide if the swearing in of Barack Obama to be President of the United States should be halted pending a hearing on his eligibility. The court will be acting on a lawsuit by Leo C. Donofrio, an attorney turned gambler claiming that the New Jersey Secretary of State (SOS) failed to certify that the names "of all such candidates for whom the voters within such county may be by law entitled to vote at such election." The Donofrio lawsuit is asking the court to issue a writ of mandamus ordering the New Jersey SOS to carry out her duties as prescribed by state statute. Donofrio claims that three persons on the ballot, Obama, McCain and Socialist Workers Party candidate Roger Calero are not qualified to hold the office of President of the United States and that the ballots were therefore "defective."
As reported by the Sonoran News on Nov. 21 Donofrio "appears to have the most promising lawsuit challenging Obama and other candidates' eligibility to become President of the United States under constitutional requirement they be 'natural born' citizens."
